Terms of Service

These Terms of Service ("Terms") govern your access to and use of TuMCP (the "Service") offered by the Operator identified on our Legal page ("we", "us", "our"). By creating an account, paying for a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
TuMCP provides a unified gateway and tooling to connect your AI agents and applications to third-party APIs and services using credentials and keys you choose to store. Features, integrations, and limits depend on your plan and what we make available from time to time. We do not guarantee uninterrupted or error-free operation.
2. Eligibility and accounts
You must be at least 16 years old (or the age of digital consent in your country) and have authority to accept these Terms. You are responsible for the accuracy of information you provide, for your account security (including passwords and single-sign-on where applicable), and for all activity under your account. Notify us promptly at dtricoma@gmail.com if you become aware of unauthorized use.
3. API keys, credentials, and third-party services
You may connect third-party products (for example: GitHub, Stripe, or cloud providers). You are solely responsible for your relationships with those providers, for complying with their terms, and for ensuring you have the rights to use and delegate access to their services. We act as a technical intermediary on your instructions; we do not control third-party APIs and are not responsible for their availability, changes, or content.
4. Acceptable use
You must not, and you must not allow others to:
- violate any applicable law, including export, sanctions, and privacy laws;
- infringe intellectual property or other rights of any person;
- probe, attack, or bypass security, quotas, or rate limits, or use the Service to distribute malware or spam;
- reverse engineer the Service except where mandatory law allows;
- resell or sublicense the Service without our prior written agreement.
5. Plans, fees, and taxes
Paid plans, billing cycles, and prices are shown at checkout or in the product. Unless stated otherwise, fees are in the currency and inclusive/exclusive of VAT as shown. Recurring plans renew until cancelled in accordance with the payment provider's flow. Right of withdrawal: if you are a consumer in the European Economic Area, you may have a 14-day right to withdraw from a distance contract for digital content, with limitations once performance has begun with your consent—see information provided at purchase and applicable law. Nothing in these Terms limits non-waivable statutory rights.
6. Changes to the Service and to these Terms
We may modify or discontinue features. We may update these Terms; we will post the updated version and revise the "Last updated" date. Where required by law, we will notify you in advance. Continued use after the effective date of material changes may constitute acceptance.
7. Intellectual property
We and our licensors own the Service, software, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with these Terms. You retain rights to your content; you grant us the license reasonably needed to run the Service (e.g. hosting, processing requests you initiate, support).
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTHING HERE EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR OTHER MATTERS THAT CANNOT BE EXCLUDED BY LAW.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD (OR, IF THE SERVICE WAS FREE, ONE HUNDRED EUROS (€100)). STATUTORY RIGHTS FOR CONSUMERS IN THE EU/EEA REMAIN UNAFFECTED WHERE THEY CANNOT BE WAIVED.
10. Suspension and termination
We may suspend or terminate access for breach of these Terms, non-payment, legal risk, or to protect the Service. You may stop using the Service at any time. Provisions that by their nature should survive (e.g. limitations, IP, governing law) will survive.
11. Governing law and disputes
These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. If you are a consumer habitually resident in the EU, you also benefit from any mandatory rules of the country where you live. For disputes, the courts of Barcelona, Spain have jurisdiction, subject to any non-waivable rights you may have to bring proceedings in your home courts.
